§ 1 Validity of the General Terms and Conditions / Subject of the Contract
These terms and conditions apply to all contracts for the rental of the holiday apartment (short-term rental) between the landlord and the guest.
Any deviating conditions of the guest shall only become effective if the landlord expressly agrees to them in writing.
The contract is concluded with the booking confirmation or acceptance of the booking by the landlord.
§ 2 Prices and payment conditions
The entire rental price must be paid in full no later than 1 week before arrival.
The amount of any deposit required depends on the length of stay and is determined individually.
Accepted payment methods include (e.g.) bank transfer, credit card or other payment methods offered by the landlord.
If payment is not made on time, the landlord is entitled to withdraw from the contract and, if applicable, charge cancellation fees in accordance with Section 5.
§ 3 Arrival / Departure
The holiday apartment is available to guests from 4:00 p.m. on the day of arrival.
On the day of departure, the holiday apartment must be vacated by 10:00 a.m. at the latest.
A later departure or earlier arrival is only possible after prior arrangement.
§ 4 Use, house rules, pets
The guest agrees to comply with the house rules. This includes, in particular, the legally required quiet hours in Germany from 10:00 PM to 6:00 AM.
Pets are not allowed in the holiday apartment.
The holiday apartment may only be occupied by the number of people stated in the booking.
Any damage or defects must be reported to the landlord immediately.
§ 5 Cancellation / Withdrawal
Cancellations are possible free of charge up to 5 days before arrival.
From the 5th day before arrival or in case of no-show, the full rental price (100%) is due.
Cancellations must be made in writing (e.g. by email).
§ 6 Deposit
A deposit may be charged.
The amount of the deposit depends on the length of stay and will be communicated to the guest before the rental agreement is concluded.
The deposit will be refunded after departure and proper return of the apartment, less any damages or additional cleaning costs.
§ 7 Registration / Misappropriation Act Berlin
The landlord is registered in accordance with legal regulations and displays his registration number.
A separate registration number is provided for each individual apartment managed by our company.
The guest acknowledges that the rental is in accordance with the applicable provisions of the Berlin Act on the Prohibition of Misuse of Property.
§ 8 Liability
The landlord is only liable for damages in cases of intent or gross negligence.
The landlord assumes no liability for items brought in by the guest unless there is intent or gross negligence.
Liability for slight negligence is excluded, except in cases of injury to life, body or health.
§ 9 Final provisions
German law applies.
The place of jurisdiction is – to the extent permitted by law – the registered office of the landlord.
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.

Payment processing via Stripe (owner as payment recipient):
For each accommodation, we use a unique Stripe payment link, which is assigned to the respective owner's Stripe account. Guests pay directly to the owner; payouts are made directly from Stripe to the owner's registered bank account. We do not hold third-party funds and do not act as a payment service provider/escrow agent. Guests are invoiced by the respective owner. Payments are processed via Stripe Payments Europe; we do not store any card or account information.

For each accommodation we publish, a unique Stripe payment link is used, which is assigned to a separate Stripe account of the owner.
The accommodation contract is concluded between the guest and the owner. Payments from the guest are made directly to the owner; payouts are made by Stripe directly to the owner's bank account.
The provider (co-host) does not accept payments, does not hold third-party funds, and does not act as a trustee or payment service provider.
Invoicing, taxes, and duties to the guest are the responsibility of the owner; the owner ensures proper KYC/identification and account deposit with Stripe.
Refunds/chargebacks are processed via the owner's respective Stripe account; the provider provides organizational support.
The co-hosting fee (e.g., 12% net/month) is invoiced separately (unless otherwise agreed in writing).

1) Scope & Definition of Consumer
This policy applies to distance selling contracts concluded by consumers (Section 13 of the German Civil Code) with Jilu Apartments GbR. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.
2) No Right of Cancellation for Accommodation with a Fixed Period
There is no right of cancellation for accommodation services (e.g., short-term rentals/holiday apartments/serviced apartments) for purposes other than residential use, provided that a specific period of time (e.g., fixed arrival and departure dates) has been agreed for the provision of the service.
The cancellation and rebooking conditions stated at the time of booking apply.
Legal basis: Section 312g Paragraph 2 No. 9 of the German Civil Code (BGB).
3) Right of withdrawal for non-scheduled services
- If you purchase non-scheduled services as a consumer (e.g., vouchers or additional services without a fixed service period), you are entitled to the following right of withdrawal.
- Right of withdrawal
- You have the right to withdraw from this contract within 14 days without giving any reason.
- Start of period
- The withdrawal period is 14 days from the date of conclusion of the contract.

- by means of a clear statement (e.g., by letter or email) of your decision to withdraw from this contract.
- To meet the deadline, it is sufficient to send your declaration before the expiry of the cancellation period. The use of our sample cancellation form (see below) is not mandatory.
- Consequences of Cancellation
If you cancel this contract, we will refund all payments we have received from you promptly and at the latest within 14 days from the date on which we received notification of your cancellation. For the refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.
Commencement of Service During the Cancellation Period (Compensation for Value)
If you have requested that we commence performance during the cancellation period, you must pay us an appropriate amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of cancellation, compared to the total scope of the contractually agreed services.
Premature expiration of the right of withdrawal
The right of withdrawal expires for fully provided services after we have begun performance with your express consent before the expiry of the withdrawal period, and you have confirmed your knowledge of the loss of the right of withdrawal.
